The defendant is not guilty. The summary of the judgment against the defendant shall be published.

1. The facts charged in the instant case [the premise facts] around July 27, 2012, the Defendant: (a) sold 2 refrout seasons (D and E) to C in total at KRW 84,50,000; (b) indicated the Defendant’s name and resident number in each form presented by C while selling 2 refrouters (D and E) to C in total at KRW 84,50,000; and (c) indicated that “the type and type of the vehicle, vehicle number, chassis number, owner, and seal (owner), address, name, and resident number” in each form; and (d) stated that “after the date of acquisition of the said construction machinery, the transferor is responsible and resolved for all debts, such as the seizure of mortgage penalties of the construction machinery, and affixed a signature and seal on each form to evidence this.”

[2] On October 27, 2014, the Defendant: (a) purchased two mined seasons from the complainant on July 27, 2012 at the office G of the law office located in the Nowon-gu Seoul Special Metropolitan City, Seocheon-si, and (b) requested the complainant to prepare a mid-term trading contract and renunciation letter; (c) made the complainant to prepare each letter of renunciation; (d) stated the name of the complainant and resident number at the bottom of the right; (e) stated the name of the complainant and the resident number; and (e) sealed the name and sealed the copy to C, and sent C two copies of the paper A4; (c) using the above paper using a computer screen program at a closed place on a date without permission, with the intention of having C take criminal punishment; and (e) made it possible for the complainant to take over each of the above construction machinery: (e) write out each of the above paper with the owner’s name and seal affixed to each of the relevant construction machinery; and (e) made it available to the transferor for resolution.
