A defendant shall be punished by imprisonment for a term of one year and two months.

The defendant is an applicant for compensation with the amount of KRW 230,00,000.

Punishment of the crime

On April 1, 2019, the Defendant posted on April 1, 2019, 02:27, the term “IPC” on the Internet “J” website in Daejeon-gu, Daejeon-gu, stating that “IPC will sell Aphone 8256GB”, and false statement was made to the victim E who reported and contacted this.”

However, the defendant did not have an intention or ability to send the goods promised even if he received money from the above victim as the price for the goods.

As such, the Defendant, by deceiving the said victim, received KRW 320,000 from the said victim via K bank account (Account Number: M) on the same day, and received total of KRW 12,220,000 from February 13, 2019 to July 11, 2019, as shown in the attached Table of Crimes List.

Accordingly, the defendant was provided property by deceiving the victims.

Around July 16, 2019, the Defendant posted a false statement on the “I” website located in Daejeon-gu Daejeon, stating that “J sells Aphone XR X 128GB,” and reported it to the victim N who contacted.”

However, in fact, even if the defendant received money from the above victim as the price for the goods, he did not have an intention or ability to send the goods promised.

As can be seen, the Defendant, by deceiving the said victim, received KRW 510,000 from the said victim to the O (Transaction Number: P) on the same day, and received a total of KRW 1,410,000 from May 6, 2019 to the said date, as indicated in the separate crime list.

Accordingly, the defendant was provided property by deceiving the victims.

around June 13, 2019, the Defendant posted a letter “I” on the “J” website located in Daejeon-gu Daejeon, stating that I sell Aphone 8 Pphones.”
