Defendant A, B, and C’s convictions and Defendant H are reversed.
Defendant
A shall be punished by imprisonment with prison labor for one year.
Reasons
1. Defendant A, B, and C
A. The summary of this part of the facts charged is that Defendant A used the trade name of “N” corporation, which is a planning real estate company in the 8th floor of Gangnam-gu Seoul Gangnam-gu, Seoul, with the name of “M” before September 7, 2009; hereinafter “K”). Defendant B took overall charge of the management of the company with the name of “M” as the president, and Defendant B took charge of duties such as employee training and customer slabing. Defendant C was in charge of real estate sales and transfer, with the name of the president, and Defendant C was in charge of duties such as job training and employee training. Defendant C was in charge of real estate sales and transfer, with the name of “N” as Defendant A’s children.
E is a general manager of P Co., Ltd. (O on March 9, 201; hereinafter “O”) and a representative director of Q Co., Ltd. (hereinafter “ Q”). F was a vice-chairperson of O and Q, who sells real estate and was in charge of funding. G was in the position of O business directors and Q real estate business, I, and Defendant H was in the position of the director of O and Q, and was in charge of real estate sales business.
D, around May 10, 2010, the Defendant A, B, and C gathered to sell the shares of the instant land to many customers, in the form of a small-scale mutual understanding, by promoting as if it is possible to divide the ownership transfer into an individual parcel, the share of the instant land into a small-scale mutual understanding.
D, Defendant A, B, and C are expected to be developed into a commercial area because the victims S had opened the second sub-exclusive highway in the front of December 8, 2010 by the K Office on the following grounds: "The second sub-exclusive highway has been opened in the front, and there has been a traffic square in the surrounding areas."
So far, the luscists knew of this, and collected neighboring land.
The land of this case is divided into individual parcels.
