The defendant's appeal is dismissed.

1. Summary of the grounds for appeal;

A. As to larceny, the Defendant paid 20,000 won per month to the commercial association with the electric utility fee for the section for common use and 50,000 won per month with the fee for the office of the rooftop office. The electric utility fee for the above section for common use and the fee for the office of the rooftop office include the electric utility from the office of the fourth floor to the public utility.

B. As to the damage of documents, G, a general secretary of the shopping district council, intended to cast a vote without following due process such as prior public announcement of the voting day, and stored and returned a ballot box of 20 minutes, and there is no fact that the voting notice form is teared.

2. Determination

A. According to the evidence duly adopted and examined by the court below as to the assertion of larceny and witness G of the trial party witness G, ① there is a store that has entered into an electricity use contract individually with Han River (hereinafter “individual contract store”) among the stores of the building C, and the latter store and the C shop entered into a single electricity use contract for the section for common use of the building en bloc (hereinafter “one-time contract store”) (hereinafter “one-time contract store”) and ② The former charges are imposed on the section for common use of the entire building by using electricity measured by one measuring instrument for the entire section for common use of the building (hereinafter “total measuring instrument”), and ③ the commercial association established a measuring instrument that measure the volume of electricity used for each exclusive section for each contract shop (hereinafter “individual measuring instrument”) and then deducted the remaining charges for the entire section for common use from the total quantity measured by each electric measuring instrument measured by all measuring instruments.
