A shall be punished by a fine for negligence of KRW 3,000,000, and by a fine of KRW 2,000,000.

The Defendants respectively.

Punishment of the crime

The Defendants are the business members of the (ju) E operated by D in Gangdong-gu Seoul Metropolitan Government 6 6 dong 601.

The Defendants provided new personal information to the advertiser of the E, and conspired with D to receive personal information acquired from D to the advertiser through the distribution of unexploitable newspapers.

1. Violation of Information and Communications Network Utilization Promotion Act;

(a) No one shall knowingly receive any divulged personal information for profit or any unlawful purpose;

Nevertheless, around November 201, the Defendant, in collusion with D, received the personal information collected by Abrupters in an abnormal manner in collusion with D, and thereafter received it from that time with the knowledge of the fact that the personal information collected by D was acquired by Ebrupters, from that time until April 14, 2014, 35,301 was knowingly provided with the same method 11 times in total, such as the list of crimes in the attached Table (1).

(b) No one shall knowingly receive any divulged personal information for profit or any unlawful purpose;

Nevertheless, the Defendant, in collusion with D on November 27, 2009, received the personal information collected by Earbiopia in an abnormal manner with knowledge that the personal information collected by Earbiopia was acquired. From that time until February 20, 2014, the Defendant knowingly received 38,186 personal information divulged by the same method over 84 times in total, such as the list of annexed crimes (2).

2. Violation of the Personal Information Protection Act;

(a) A person who manages or has managed personal information of Defendant A shall divulge or be different from that of Defendant A without authority.
