Reasons
Punishment of the crime
1. Defendant B and C’s joint criminal conduct had the mind to open a gambling place, and had friendly Defendant C told Defendant C to “hing to open a gambling place in order to pay monthly pay.” Defendant C, upon accepting Defendant B’s proposal, had the mind in the gambling place and want to walk out time and site expenses from the participants.
From June 4, 2012 to June 8, 2012, the Defendants conspired in collusion with each other to set a gambling room in the 3rd room of Gwangju Dong-gu Jud Store, Gwangju, and had A, E, D, C, K, etc. play gambling by using 52 copies of the card, as described in the following paragraph 2, and opened the so-called Baduk for profit by walking 50,000 won per person’s site and 10,000 won per hour.
2. Joint criminal conduct of Defendant B, A, E, and D;
A. The Defendants, together with K, carried out gambling over approximately 250 times by putting the original deposit between Defendant D and Defendant D from June 4, 2012 to June 19:00 on the following day, and making up approximately KRW 8 million each by putting up a card of KRW 52,000,000, and by putting up the card of KRW 52 card, using each 52 card, changing the card and printing cash on three occasions, and putting up cash to a person with a low number in otherless pattern.
B. The Defendants together with K, and Defendant D habitually ended from June 5, 2012 to June 19:00, and from June 5, 2012 to 00:00 the next day, the Defendants ambling for approximately KRW 10 million in the said place and 200 times through the same method.
C. The Defendants together with K, and Defendant D habitually ended from June 8, 2012 to June 19:00, and from June 8, 2012 to the next 01:00 of the following day, Baduk spawd around KRW 10 million and 200 times through the same method.
3. The Defendant, from June 12, 2012 to June 22, 2012, was living together with the victim B, E, D, and K in the same place for about five days.
