"2017 Gohap 606: Defendant A's crime
1. The Defendant and related persons are the representative director of M&A, a development company related to information and communications in Geumcheon-gu Seoul, from around April 14, 2010 to around December 12, 2010, who was declared bankrupt by the Seoul Central District Court on December 14, 2016 and was in general in charge of management of the above company; C is a person who was in charge of management of M from April 14, 2010 to July 2016; B is a person who was in charge of management of M from around July 14, 2015 to work as the head of the Information Planning Team (Grade 2) and was in charge of planning affairs related to information and communications from around January 14, 2012 to December 2013; and C is a person who was in charge of planning affairs related to information and communications from around December 15, 2013 to around December 205, 201 (Grade 2).
2. The defendant and B, and the defendant and C, who received orders from the N agency contracts of M, were in charge of the duties while performing orders from around 1997 to the other company, before operating M. respectively.
After becoming aware of B, the Defendant maintained friendship, such as entering the same in a private job. On April 14, 2010, the Defendant was appointed as the representative director of M on the same day, and C was appointed as the inside director of M on the same day, and B was ordered as the head of the Information Planning Team in charge of ordering and managing various services related to information and communications of N agencies around January 2012.
A. On January 2013, 2013, C entered into a subcontract for N agency’s ordering services requested that B “do have been able to obtain a subcontract for computerized services for the production facility drawings ordered by N agency.” This means that B around that time, P of the representative of the Dispute Resolution Bank Co., Ltd. prepared to receive the above services in a restaurant located in Seongbuk-gu, Seongbuk-gu, Seongbuk-gu, and thereafter, N agency will select the above service provider.
