A defendant shall be punished by imprisonment for not less than one year and six months.

However, the execution of the above punishment shall be suspended for two years from the date this judgment becomes final and conclusive.

Punishment of the crime

The defendant and the victim B(the 62 years of age) are married between the couple.

1. Around June 6, 2020: (a) around the “D” factory located in Yongsan-gu, Yongsan-gu, U.S., U.S., U.S., U.S., U.S. and U.S. (hereinafter “D”) operated by the Defendant, the Defendant brought a dispute with the victim as a matter of repair of the devices; (b) golf loans, which are dangerous articles kept in storage in a warehouse, are put up with the victim; (c) the victim’s shoulder with the above golf loans one time; and (d) the Defendant was her handed with the victim’s left her hand.

In this respect, the defendant carried dangerous objects and assaulted the victim.

2. The special confinement and the special intimidation prosecutor changed the indictment of this part.

피고인은 2020. 6. 6. 19:34경 제1항과 같이 피해자를 강제로 끌고 위 ‘D’ 공장 건물 안으로 들어와 출입문을 잠근 뒤, 위 출입문 경첩에 라쳇 렌치(길이 약 30cm)를 끼운 뒤 망치로 때려 단단하게 고정시키고, 피해자가 위 라쳇 렌치를 풀고 밖으로 나가려고 하자 피해자가 나가지 못하도록 손으로 잡아끌어 제지하고, 피해자가 휴대폰으로 112신고를 하려 하자 위 휴대폰을 빼앗아 공장 벽면을 향하여 던지고, 담배를 입에 물고 라이터로 불을 붙인 상태에서 위 건물 안에 있던 위험한 물건인 LP 가스통에 불을 붙이려는 태세를 보이며 피해자에게 “같이 죽자.”라고 말하였다.

As a result, the Defendant’s act of intimidation from the above temporary point of view to around 19:40 on the same day by carrying a dangerous object for about six minutes until the police officer opens the entrance of the building at the same time and detained the victim, and at the same time, as a means for confinement, does not constitute a separate crime of intimidation by absorbing the crime of confinement (see Supreme Court Decision 82Do705, Jun. 22, 1982). The crime of special intimidation in this case is specifically against the life and body of the victim using dangerous objects other than the means of confinement.
