A defendant shall be punished by imprisonment for not less than eight months and a fine not exceeding two hundred thousand won.

However, the above imprisonment for two years from the date this judgment becomes final and conclusive.

Punishment of the crime

1. On March 22, 2019, the Defendant violated the Road Traffic Act: (a) around 22:40, while under the influence of alcohol with a blood alcohol concentration of 0.161% without a driver’s license, the Defendant was driving a two-lane road in front C in Gwangjin-si B, and led the Defendant to drive a two-lane road in front of Gwangjin-si B in the e apartment room, using a F-section.

At the time, there are many vehicles parked as on-road parking lots at night and two lanes, so in such cases, the defendant engaged in driving of the motor vehicle has a duty of care to safely drive the steering gear and brakes by reducing speed and accurately manipulating the steering gear.

Nevertheless, due to the negligence of neglecting this, the Defendant neglected and proceeded bypassing and driving the vehicle without notifying the victim of the personal information, and left the place of the accident without notifying the victim of the repair cost equivalent to KRW 615,527 of the repair cost, which is maintained in two-lanes by G as the front part of the right-hand part of the vehicle of the Defendant driving.

2. Around 22:40 on March 22, 2019, the Defendant violated the Road Traffic Act and the Road Traffic Act (driving without a license) driving a L low-income vehicle under the influence of alcohol content 0.161% without a vehicle driver’s license, with a volume of approximately 1 km from the roads front of J cafeteria located I in Gyang-si to the roads front of Gamyang-si K apartment in Gwangju-si.
