The defendant shall be innocent.
Reasons
1. On March 14, 2012, the Defendant stated that the victim E in D hotel coffee shop located in Gangnam-gu Seoul Metropolitan Government, “B worked in the past Samsung Samsung, and currently is working in the rostm against Korean power, and if the State increases the total amount of the contract amount of KRW 24 billion in the amount of KRW 240 million, the victim’s company, and the F Co., Ltd. and the Korea Western Power Plant Development Co., Ltd., jointly developed, would have concluded a long-term supply contract for mixed carbon call, which is used as fuel for coal-power power plants.”
However, even if the defendant received money from the victim for the purpose of raising money, he did not have the intention or ability to conclude a contract for supplying goods with the Korean Western Development Co., Ltd.
Nevertheless, the Defendant, as seen above, was issued a total of KRW 90 million on three occasions, including KRW 30 million on March 14, 2014, KRW 20 million on March 28, 2014, KRW 40 million on April 24, 2014, and KRW 90 million on April 2, 2014.
2. The burden of proof for the criminal facts prosecuted in a criminal trial for judgment is to be borne by a public prosecutor, and the conviction is to be based on evidence with probative value that makes a judge feel true beyond a reasonable doubt. Thus, if there is no such evidence, the suspicion of guilt is between the defendant, even if there is no such evidence.
