Reasons
Punishment of the crime
The Defendant is a person who operates a general restaurant “D” on the Seongbuk-gu C and the first floor of Daejeon Metropolitan City.
A person who prepares and sells agricultural and fishery products or the processed products thereof shall not place a false indication of the place of origin or place a mark likely to cause confusion thereon.
During the period from August 29, 2015 to January 16, 2016, the Defendant purchased F and G Mt, Daejeon Woo-gu located in Bupyeong-gu, Incheon, 1,175.4gg, 3,618,696 won of Canada’s raw milk 42.8kg, 342,400 won of the U.S. raw milk for the use of Stinctive Sea, and 57.47kg, 340, 646 won of Germany’s U.S. raw milk 2015, and 61kg, 416,50 won of the Austria, 301.79kg, 265, 908, 747, 747, 767, 767, 747, and 747, etc. of the Republic of Korea’s raw milk.
During the period from August 29, 2015 to January 18, 2016, the Defendant sold to customers approximately KRW 7,920,00 of the sugar 1,920,00 of the imported swine Canadian tree cream bones 1,131km purchased from the “D” restaurant operated by the Defendant, and indicated the origin in a separate place of origin on the “D,” indicating that the Defendant sold approximately KRW 12,096,00 of the Ssamsan, prepared in the sum of 448 km clives of the U.S. C., Germany, and Austria, to customers.
As a result, the defendant sold food that cooked swine in the restaurant, and made a false indication of origin or a false indication that may cause confusion.
