The defendant's appeal is dismissed.

1. Summary of reasons for appeal: The defense counsel of the defendant who misleads the misunderstanding of facts added the sentencing on the grounds of unfair appeal on June 25, 2018, but this cannot be a legitimate reason for appeal since it is alleged after the lapse of the period for filing the appeal, and there is no ground for reversal ex officio. Thus, the above argument by the defense counsel is without merit.

The defendant was the same as the vehicle of the victim, and did not have any intention to intimidation the victim or damage the property of the victim.

However, the lower court: (a) threatened the victim with a passenger car, which is a dangerous thing by the Defendant; and (b) damaged the victim’s property.

Since the judgment of the court below was accepted, it erred by misunderstanding the facts and affecting the conclusion of the judgment.

2. In full view of the following circumstances acknowledged by the evidence duly adopted and examined by the court below, the defendant could be admitted that the defendant threatened the victim with a passenger car, which is a dangerous object and damaged the victim's property as stated in the judgment below. Thus, this part of the defendant's assertion is without merit.

① The Defendant was proceeding along the four-lane distance from Samsung Ne-distance to the one-lane from Samsung Ne-distance. However, the Defendant changed the two-lane from three-lane to one-lane on the ground that the victim’s vehicle changed the two-lane.

② Since then, the Defendant attempted to make a right-hand way on the two-lanes at the time when the damaged vehicle was making a right-hand way on the three-lanes in the central market, and thereafter, the Defendant driven a vehicle in an abnormal manner, such as moving the damaged vehicle beyond the central line, moving the damaged vehicle over the central line, and driving the vehicle in front of the damaged vehicle.

③ Although the Defendant asserts that he was in the length to which he was running, it is very difficult for the Defendant, who was trying to turn to the left at the intersection, to pass the damaged vehicle beyond the median line.
