Defendant
A Imprisonment with prison labor of seven years and fines of 120,000,000 won, fines of 5,000,000 won for Defendant B and Defendant C shall be punished by imprisonment with prison labor of eight months.
Reasons
Punishment of the crime
1. Defendant A, from May 1, 2013 to May 1, 2013, obstructed the performance of the official duties by fraudulent means by Defendant A, the head of the aviation department at F University (hereinafter “F University”) (hereinafter “F University”) (hereinafter “this department”). Defendant C, from June 201 to June 201, was the officer entering the F major Global Admission Center, and Defendant B, from April 2014 to the F major Global Admission Center, was the assistant professor of the department. Defendant A and Defendant B were the officers commissioned from April 2015 to the same department, and Defendant C, as the officer entering the school, took charge of the official duties by screening documents and interviewing the students from 2016 to 2018.
Article 4(1) of the Framework Act on Gender Equality provides that “All citizens shall have the right to receive equal treatment for cultivation in all areas, such as family and society, and to engage in an equal life for cultivation.” Article 5(1) of the same Act provides that all State agencies shall endeavor to realize equality of cultivation.
Accordingly, FJ has maintained the principle of evaluation according to the ability of applicants regardless of gender, blood, delay, academic research, gender, religion, economic status, social status, etc. as well as gender in selecting students.
B. In order to select new students by comprehensively assessing the grade, potential, talents, creativity, etc. of students, FJ has prepared detailed procedures such as the avoidance and exclusion system, similar search system, etc. to ensure fairness in evaluation while introducing the “student-based comprehensive screening system.”
On the other hand, the subject of this case carried out the so-called “G” in the process of a student secondary screening from the 2016th to the 2018th 2018. In order to realize the fair evaluation procedure as described above, the subject of this case is the student score whose average tin rating is quantitatively assessed at the time of the first stage document evaluation.
