1. The defendant shall be punished by imprisonment for eight months;

피고인은 구미시 C 게임랜드’라는 상호로 게임장을 운영하는 사람이다. 1. 등급분류 받은 내용과 다른 내용의 게임물을 이용에 제공한 점 누구든지 등급분류를 받은 게임물과 다른 내용의 게임물을 유통 또는 이용 제공 및 전시ㆍ보관하여서는 아니 된다. 그럼에도 불구하고 피고인은 2012. 7. 29.경부터 2012. 8. 30.경까지 위 게임장을 운영하면서 성명불상자로부터 구입한 ‘레전드 오브 히어로 스페셜 에디션' 게임기 40대를 설치한 후, 위 게임기들이 당초 등급분류를 받은 내용과는 달리 게임자동진행장치 속칭 '똑딱이'를 이용하여 이용자의 조작 없이 자동으로 진행되고, 게임기의 카드배출기 내부에 환전용 아이템 카드를 충전할 수 있도록 별도의 공간이 설치되어져 있으며, 별도의 프로그램 파일을 이용하여 위 환전용 아이템 카드가 무작위로 배출될 수 있도록 개조된 것임을 알면서도 그곳을 찾은 불특정 다수의 손님들로 하여금 위 게임기들을 이용에 제공하였다.
