Defendant shall be punished by a fine of three million won.

If the defendant does not pay the above fine, KRW 100,000.

Punishment of the crime

The Defendant is a person who operates the CPC bank, the third floor of the Seoul Jung-gu building B in Seoul.

1. No person who violates the Telecommunications Business Act may intermediate a third party's communications using telecommunications services provided by a telecommunications business operator, or provide such services for communications;

Nevertheless, from August 1, 2018 to January 15, 2019, the Defendant provided a large number of unspecified customers who find a business place at the above “CPC room” with telephone apparatus installed at the above business place and provided them with telephone conversationss with unspecified women, and accordingly received 15,000 won per hour.

2. A person who intends to run a video viewing business in violation of the Promotion of Motion Pictures and Video Products Act shall register with the head of the Gu, equipped with the facilities prescribed by Ordinance of the Ministry of Culture

From August 1, 2018 to January 15, 2019, the Defendant provided a video viewing business with multiple partitioned viewing rooms and video product viewing equipment without registering with the competent Gu office.

3. No person who violates the Act on Promotion, etc. of Information and Communications Network Utilization and Information Protection (Distribution of obscenity) shall distribute information with obscene content distributed, sold, rented, or displayed openly through an information and communications network.

Nevertheless, the Defendant, at the time and place indicated in the preceding paragraph, connects the eight server computers with approximately 0.5 square meters stored in eight rooms, where approximately 200 obscene materials are stored, to a large number of unspecified customers who found the server and a network, and guide them to a closed room with an amount of 6,000 won per hour for viewing obscene materials through a computer connected to the server and a computer, thereby allowing many unspecified customers to peruse and watch obscene videos, thereby allowing them to view and watch obscene videos, through an information and communications network.
