2. 피고인 C은 2013. 3. 12. 15:30경 위 주유소에서 피고인 D에게 M 탱크로리 차량에 등유를 적재한 후 불스원샷 3~4병을 혼합하여 가짜 경유를 만들도록 지시하고, 피고인 D은 이에 따라 가짜 경유를 제조하고, 피고인 C은 같은 날 19:38경 종업원인 N과 함께 김해시 삼계동에 있는 아이파크아파트 맞은편 주택가 도로로 위 탱크로리를 운전하여 가 O의 P 화물차에 가짜경유 약 120리터를 주유하였다.

3. 피고인 C은 2013. 3. 13. 오전 무렵 위 주유소의 M 탱크로리에 등유를 적재하고 불스원샷 3~4병을 넣어 가짜경유를 제조한 후 피고인 D에게 김해시 Q에 있는 ‘R’으로 운전하여 가 주유하도록 지시하고, 위 D은 이에 따라 위 탱크로리를 운전하여 가 ‘R’에 있는 S의 T 화물차와 U 화물차에 가짜경유 합계 약 422리터를 주유하였다.
