1. The Plaintiff:
A. As regards Defendant Daewoo Construction Co., Ltd, KRW 536,609,222 and its total KRW 210,000,000 shall be applicable.
Reasons
1. Basic facts
A. 1) The Plaintiff is an apartment A (7 Dong-dong 717 households, hereinafter “instant apartment”) located in Bupyeong-gu Incheon, Bupyeong-gu.
2) In order to manage the apartment complex of this case, C Housing Redevelopment Development and Rearrangement Project Association (hereinafter “Industrial Complex”) is a project proprietor who constructed and sold the apartment complex of this case, and the Defendant Treatment Construction Co., Ltd. (hereinafter “Defendant Treatment Construction”) is a company which constructed the apartment complex of this case upon contract from the non-party partnership, and the Defendant Housing Guarantee Co., Ltd. (hereinafter “Defendant Housing Guarantee”) is between the Defendant Treatment Construction Co., Ltd. (hereinafter “Defendant Housing Guarantee”).
It is a guarantee company that concludes a warranty contract for the apartment of this case and issues a warranty bond.
B. On September 23, 2011, in the event that Defendant Daewoo Construction fails to perform the obligation to repair defects arising from the instant apartment on or before the conclusion and approval for the use of the warranty contract, Defendant Daewoo Construction Co., Ltd. entered into each of the warranty contracts with the head of Bupyeong-gu Incheon Metropolitan City, Bupyeong-gu, Incheon Metropolitan City (hereinafter “each of the warranty contracts of this case”) to pay the warranty bond within the period and amount set forth in [Attachment 1] set forth below to the head of Bupyeong-gu
