Punishment of the crime

1. Defendant A

A. Around 04:30 on December 3, 2017, the Defendant: (a) was deprived of the victim E (here, 29 years of age)’s upper and lower parts of the victim E (here, she was able to engage in sexual intercourse with the victim’s sexual organ on the part of the victim’s body; and (b) did not result in an attempted crime because the Defendant tried to engage in sexual intercourse with the victim’s sexual organ on the part of the victim’s body; and (c) did not result in such intent.

Accordingly, the defendant attempted to have sexual intercourse with the victim's failure to resist or to resist by taking advantage of the victim's condition of mental disorder.
