Reasons
Punishment of the crime
[Criminal Power] On January 11, 2018, the Defendant was sentenced to eight months of imprisonment for fraud at the Cheongju District Court, and completed the execution of the sentence in the Cheongju Prison on July 16, 2018.
【Criminal Facts】
1. On November 28, 2018, the Defendant demanded the victim to operate a bus terminal located in Heak-gu, Soak-gu, Soak-gu, Soak-gu, Soak-gu, Cheongju-si, to the bus terminal located in 6, Cheongju-gu, Soak-gu, Cheongju-si, as if he would normally pay the taxi fee.
However, in fact, the Defendant did not have any particular property or occupation, and did not have any means of payment, such as cash or credit card, so even if using the taxi as above, he did not have the intent or ability to pay the price.
The Defendant had the victim operate a taxi to the bus terminal of the Cheongju-si, and did not pay 7,220 won of the taxi fee, thereby acquiring property benefits equivalent to the same amount.
2. The Defendant stated in the indictment on December 29, 2018 as December 28, 2018, but according to evidence, it appears to be a clerical error as of December 29, 2018, and thus, it is corrected as above.
At around 03:00, in front of the E-mail located in the petition-gu, Cheongju-si, the victim F was on a G-si operated by Cheongju-si and demanded the victim to be operated to the Cheongju-si bus terminal located in 6 U.S., Seo-gu, Cheongju-si, Cheongju-si, as the victim F would normally pay the taxi fee.
However, in fact, the Defendant did not have any particular property or occupation, and did not have any means of payment, such as cash or credit card, so even if using the taxi as above, he did not have the intent or ability to pay the price.
The Defendant had the victim operate a taxi to the bus terminal of the Cheongju-si, and did not pay 17,000 won of the taxi fee, thereby acquiring property profits equivalent to the same amount.
3. On January 2, 2019, the Defendant sought from Cheongju on January 2, 201.
