1. Defendant A
(a) The defendant shall be punished by imprisonment with prison labor for six months;
(b)Provided, That the above sentence shall be imposed for a period of one year from the date this judgment becomes final.
Reasons
Punishment of the crime
The Defendants, who are not authorized to handle the psychotropic drugs, did not deal with the psychotropic drugs-related clickphones (one clickphone; hereinafter referred to as “clickphones”), but dealt with the following clickphones.
1. Defendant A
A. (1) On August 9, 2016, the Defendant purchased philophones by taking one philophones containing approximately 0.31g of philophones from Ean Park E in Ansan-si, Annyang-si, Annyang-si, the Defendant paid KRW 300,000 in cash to B.
(2) On August 13, 2016, the Defendant deposited 550,000 won into the bank account in the name of the F designated by B with the request of B to rescue the phiphones, and purchased the phiphones by taking two chophones from B prior to 507, supra, around August 14, 2016, at around 11:00, Hmophones in the name of F, which was designated by B.C. 0.46g of phiphones.
(b) The Defendant, who administered a scopon, shall be the scopon-si of Ansan-si, around 14:00 on August 10, 2016;
I. From 102 to 06:00 on August 14, 2016, the philophone was administered four times in total in the same manner as indicated in the Schedule of Crimes (1).
2. Defendant B
A. On December 2015, the Defendant administered 0.03 ghon in the mutual influoral telephone in the vicinity of the Daegu J Station by means of tamping 0.03ghon in a cluoral, and from that time to August 2016, the Defendant administered cluoron eight times in total, as shown in the list of crimes (2) in the same manner.
B. Around 14:00 on August 9, 2016, the Defendant sold a philophone with a single injection device containing approximately 0.31g of philophones in a park located in Ansan-si, Annyang-si, with a cash of KRW 300,000,000 and approximately 0.31g of philophones.
(2) On August 13, 2016, the Defendant received a written request from A to rescue a philopon from A and received K (B).
