A defendant shall be punished by imprisonment for not less than eight months.
Reasons
Punishment of the crime
1. On July 21, 2011, the Defendant concluded on July 21, 201, that “Around 12:30 on July 21, 201, the Defendant made a false statement to the Victim C at the cafeteria cafeteria cafeteria cafeteria cafeteria cafeteria Station in Ulsannam-gu, Ulsan-gu, Seoul.”
However, even if the defendant receives the above money, the defendant did not have the intention or ability to receive the auction goods from the victim because he had the purpose of using them as the cost of a separate auction for movable property.
Nevertheless, the defendant was given 5 million won as an auction fee from the victim, i.e., the victim.
2. On July 29, 2011, the Defendant, at around 14:00 on July 28, 201, presented a copy of the register of the apartment owned by the Defendant in Ulsan-gu, Ulsan-gu, Seoul-do, “E” (hereinafter “E”), and rejected the Defendant’s refusal on the ground that the priority mortgage has been established on the above apartment, the Defendant would create a right to collateral security on the apartment owned by the Defendant. However, on the ground that the priority mortgage has been established on the apartment, the Defendant would give priority to the buyer as if he/she was placed by auction of factory machinery that has more than 10 million won.”
However, the defendant did not have any intention or ability to complete the payment even if he borrowed the above amount from the victim because he did not receive a successful bid for factory machinery of more than 100 million won at an auction.
Nevertheless, on July 29, 201, the Defendant received 30 million won from the victim for a check in front of a corporate bank located in the Nam-gu Busan Metropolitan City, Ulsan Metropolitan City.
3. On August 26, 2011, the Defendant of fraud, on August 25, 201, phone called to the victim at around 20:00, to use it only for two months and return.
The sum of interest that has been lent before the payment of interest shall be 2 million won per month.
