Criminal facts

1. Defendant C, D, E, G, A, D, B, E, and G are foreigners of Vietnam’s nationality with whom Nonindicted Party’s identity, which is the same Vietnam’s nationality, cannot be known, as well as L/C’s house located in Asan City M from January 19, 2013 to January 23:00 of the following day, from January 19, 2013, the victim N (34 years old) and the foreigners of Vietnam’s nationality under the name of Vietnam, and one-time called “speed belt” in the name of Vietnam’s traditional gambling. On the contrary, their behavior would lose 10 million won in total when the victim followed money, and the victim was suspected as having committed fraud, and then the victim was able to recover the money by committing fraud.

Around 01:00 on January 20, 2013, Defendant G proposed to the effect that “N was making a fraudulent gambling and receiving money that we have lost,” Defendant G, C, D, and E conspired to collect money from the victim.

이에 피고인 G은 피해자를 붙잡아 방안으로 끌고 들어간 후 도망가지 못하도록 출입문을 잠그고 피해자의 몸을 수회 때리며 그곳에 있던 노끈(증 제2호)을 이용해 피해자의 손목을 묶으며, 피고인 C은 피해자에게 사기도박을 한 이유를 따지면서 그곳에 있던 흉기인 칼(총길이 55cm , 칼날길이 40cm , 증 제1호)을 손에 들고 피해자의 손목을 향해 내리치는 시늉을 하고 양손으로 피해자의 목을 잡고 땅바닥에 쓰러뜨려 주먹과 발로 피해자의 온몸을 수회 때리고, 피고인 D은 피해자에게 “사기도박 피해금 명목으로 300만 원을 내놓으라.”고 요구하면서 손으로 피해자의 멱살을 잡아 밀고당기며 손바닥으로 피해자의 온몸을 수회 때리고 피해자로부터 그 소유의 시가 56만 원 상당의 금귀걸이 2개, 시가 120만 원 상당의 금팔찌 1개를 빼앗으며, 피고인 E는 피해자에게 "사기도박을...
