The plaintiff's claim is dismissed.

Basic Facts

The plaintiff is a member of C, D, a member of C, and C is a representative of C, an agricultural partnership E (hereinafter referred to as “E”).

D receives money from the Plaintiff, E, or C’s account as listed below.

On December 17, 2018, Plaintiff 1 transferred KRW 40 million to the E’s account on December 20, 2019, Plaintiff 1, D 50,000,000 (D 150,000,0003 F 3, April 1, 2019, Plaintiff 4 C 13,00,000,000 (hereinafter “money”) transferred to the Plaintiff’s East F on April 3, 2019, to the Plaintiff’s account on May 20, 2019, the Plaintiff transferred KRW 40,000,000 to the Plaintiff’s account on May 30, 2019.

On December 19, 2018, Defendant 40,000,000 2D 2 D 10,000,000 on January 2, 2019, Defendant 10,000 3D 10,000 4 D 10,000 on January 13, 2019; Defendant 40,00,000 5 D 10,0005 D 14 on January 14, 2019; Defendant 10,000,006 D 10,006 D 206 D 10 on February 12, 2019; Defendant 200,6 D 100,006 D 10,007 D 10,007 D 20 on March 21, 2019; and

On February 4, 2020, the Plaintiff demanded the Defendant to repay the above loan debt until the end of March 2020, and requested the Defendant to repay the loan debt on April 3, 2020.

Therefore, the defendant shall serve the plaintiff a copy of the complaint of this case, which is 233,040,000 won and after the date of the request for performance.
