1.On a request for change in exchange at the time of the trial,

A. The Plaintiff’s 1,584m2 and the Defendant’s forest land B in Kimhae-si.

1. Basic facts

A. The Plaintiff’s acquisition of land in this case 1) was previously owned by E and D (E: E 1,587/4760, D 3,173/4760) with the previous land of 4,760 square meters in F forest land in Kimhae-si. 2) The Plaintiff: (a) on May 9, 2006, pursuant to the public notice on approval of the G construction project implementation plan (O of April 16, 2005) and the public notice on approval of alteration of the implementation plan for G construction (the Ministry of Construction and Transportation Notice P of February 23, 2006) (the Ministry of Construction and Transportation notice of February 23, 2006), the part of 1,584 square meters in the above forest as B, and the part of 71 square meters in the above forest as C (hereinafter “each land in this case”; and (b) if the land is specified, only the parcel number is omitted, and only the share of E among the land in this case.

3) On November 10, 2006, the Defendant acquired F land and the remaining D shares (3,173/4760) of each of the instant lands through a voluntary auction. 4) On December 6, 2006, the Plaintiff acquired the Defendant’s co-ownership shares in each of the instant lands by agreement.

B. On June 30, 2008, the Defendant divided the part of 1,203 square meters adjoining C into H land out of 3,105 square meters of F forest land into 3,105 square meters on June 30, 2008. 2) On July 14, 2008, the Defendant filed a share transfer registration based on the partition of co-owned property as to the whole shares E in the part of 168 square meters adjoining H land. The said part of land was divided into I land.

3) On the other hand, on May 10, 2010, F land was subject to registration conversion (the area of 1,902 square meters and 1,707 square meters, and the area of 1,707 square meters) with J land was divided into Q land on May 22, 2012, and the remainder of J land is adjacent to B. (c) Kim Jong-si, on September 19, 2012, pursuant to Article 84(2) of the former Act on Land Survey, Waterway Survey and Cadastral Records (amended by Act No. 12738, Jun. 3, 2014) and Article 82(1)5 of the Enforcement Decree of the same Act, and notified the Plaintiff, etc. thereof.

The area of J land shall be 897 square meters according to the correction of the above cadastral boundary.
