Punishment of the crime

[2012 Highest 997] On May 19, 2010, the Defendant was delegated with a mining business transfer contract with the representative director D in the victim C office located in Ansan-si B on May 16, 2010, and was transferred USD 126,000 (limited to KRW 15,000,000) for the payment of contract deposit to the agricultural bank account in the name of the Defendant.

While the Defendant kept the above money for the victim, at around that time, embezzled USD 56,00 (Korean Won 67,000,000) out of the above money for the Defendant’s business fund, etc.

On July 2010, the Defendant was introduced by the victim I and the victim J, who was engaged in selling by-products from slaughter, such as intestine G and H, at the Defendant’s residence in Kimpo-si F.

As above, the Defendant stated to the effect that “When a slaughterhouse located in Seoul Ambro-dong moves to the Chungcheong voice, 20% out of the total quantity of the inner organs emitted from slaughter shall be paid by E organizations as dividends to the victims, the Defendant would do 300 million won as security deposit to the Hamman on December 2010.”

However, the Defendant was not well aware of whether the E organization can receive 20% of the amount of by-products from slaughter, and there was no authority to exclusively supply the by-products from slaughter as above, and it was thought that the amount received as a deposit from the victims would be invested in the construction business, etc. being implemented in Vietnam.

around August 2010, the Defendant received 150 million won in total, including 15 copies of checks with 10 million won under the pretext of a deposit for the monopoly supply of by-products slaughtered from the victim J and 10 million won in total from the victim I under the same name, through the above G.
