1. Basic facts

A. The Plaintiff is a company engaged in the production and sales business of ready-mixeds. The Defendants are co-contractors who entered into a contract on the main facilities of the 1, 2nd unit nuclear power located in Soulgjin-gun, Chungcheongnam-gun, Chungcheongnam-do, Seoul (hereinafter “Korea hydroelectric Power Co., Ltd.”) with the Korea hydroelectric Power Co., Ltd. (hereinafter “Korea hydroelectric Power Co., Ltd.”) for the main facilities of the 1, 2nd unit (hereinafter “instant main facilities”).

B. On September 7, 2010, the Plaintiff entered into a service contract for concrete production works between the Plaintiff and the Defendants (i.e., the conclusion of a service contract for concrete production works) and the Defendants for concrete production works necessary for the instant main production works (hereinafter “instant concrete works”).

(2) On September 7, 2010, the Plaintiff entered into a service contract with the Defendants to produce and transport necessary quantity of concrete during the construction period from September 7, 2010 to December 31, 2011 (hereinafter “instant contract”), and thereafter, the instant contract was modified to add a certain quantity of concrete during the construction period until December 31, 201, as a result of the extension of the construction period, until December 31, 2016.
