피고인은 2005.경 내림굿을 받고 속칭 ‘신엄마(내림굿을 해준 무속인)’의 무속활동을 약 1년간 일시 보조한 후 9년여에 걸쳐 별다른 무속활동을 하지 않은 채 지내오다가 2012.경 울산 남구 B으로 이사한 이래, 피해자 C가 운영하는 ‘D’에 출입하며 위 피해자 및 그 동네 주민인 피해자 E 등과 사귀어 오던 중, 그들이 평소 집안일이나 가게를 운영함에 있어 점을 보는 등 무속인에게 의지한다는 것을 알고, 2015. 1.경 피해자들에게 ‘작두타는 명성할머니신을 받았다.’고 말을 하여 관심을 끌고, 그 후로 마치 자신이 별도의 신당을 갖추어놓고 수시로 다른 무속인들과 함께 굿당에서 굿을 하고 마지막에는 자신이 직접 작두를 타는 형태의 굿을 해 온 전문 무속인인 것처럼 행세를 하며 피고인의 무속활동 경력과 능력에 대하여 점차 과장하여 피해자들을 현혹해 나가고, 필요한 경우 갑자기 표정과 목소리를 바꾸어 할머니신이 내려온 것 같은 시늉을 하며 길흉을 좌우할 것은 태도를 보여 피고인을 맹종하게 하면서 아래와 같이 계속적으로 범행하였다.
