1. The Defendant is classified into the Plaintiff by credit card from April 1, 2015 to July 31, 2017.
Reasons
1. Basic facts
A. On July 18, 2012, the Plaintiff entered into a credit card membership agreement with the Defendant’s telegraph (hereinafter “Defendant”) (hereinafter “instant contract”) around July 18, 2012, the Plaintiff: (a) transferred all rights and duties relating to the credit card business division to D Co., Ltd. after dividing the Defendant into a company; and (b) subsequently D Co., Ltd. merged E Co., Ltd. on December 1, 2014, changed its trade name into B Co., Ltd. (hereinafter “Defendant”); and (c) entered into a credit card membership agreement with B Co., Ltd. (hereinafter “instant contract”); and (d) issued the instant card.
The term of validity of the instant card issued by the Plaintiff was up to July 31, 2017. The annual fee was KRW 100,000, but the Defendant agreed to provide additional services, including the provision of Boschen mileage (which can be converted into the mileage of G or H aviation) at the rate of 2,500 won per 1,500 won, in addition to services arising from the original function of the credit card at the time of the instant contract.
B. Around February 26, 2013, the Defendant changed the percentage of mileage accumulation through its Internet homepage, notice, etc., announced that the percentage of mileage accumulation provided to members of the instant card from September 1, 2013 to 1,500 won per 1,500 Won. Accordingly, the Defendant provided the Plaintiff with mileage accumulation according to the reduced percentage of mileage accumulation from September 1, 2013 to March 2013.
C. The part of the Defendant’s standard terms and conditions applicable at the time of the instant contract (amended by December 13, 2010), among the Defendant’s personal member terms and conditions (hereinafter “instant standard terms and conditions of additional services reduction”), concerning the reduction of additional services (hereinafter “instant standard terms and conditions of additional services”).
