1. The Defendant is the amount used by each credit card to the Plaintiff from May 1, 2015 to September 30, 2017.
Reasons
1. Basic facts
A. On August 2012, the Plaintiff entered into a credit card membership agreement with the Defendant’s telegraph (hereinafter “Defendant”) (hereinafter “instant contract”) that is the Defendant’s overall transfer of credit card holders: (a) divided the Company D into a company and transferred all rights and duties relating to the credit card business division to E; and (b) subsequently, E Company merged F Company on December 1, 2014 and changed its trade name to B Company (hereinafter “Defendant”) by absorbing F Company; and (c) without distinguishing B and B Company (hereinafter “Defendant”); and (d) entered into a credit card membership agreement (hereinafter “instant agreement”).
The term of validity of the instant card issued by the Plaintiff was until September 30, 2017. The annual fee was KRW 100,000, but the Defendant agreed to provide additional services, including the provision of mileage at the rate of two days per 1,500 won per the amount used, in addition to services arising from the original function of the credit card at the time of the instant contract.
B. Around February 1, 2013, the Defendant changed the percentage of mileage accumulation, through its Internet homepage, notice, etc., announced that the percentage of mileage accumulation provided to the instant card members from September 1, 2013 is reduced to 1,500 won per 1,500 won. Accordingly, the Defendant provided C mileage to the Plaintiff according to the percentage of mileage accumulation reduced from September 1, 2013 to April 30, 2015.
C. The main contents of the Defendant’s standard terms and conditions (amended by December 13, 2010; hereinafter “instant standard terms and conditions”) that were applied at the time of the instant contract are as follows.
Article 14 ( Points and Other Services) (3) Additional services such as points and discount benefits provided on credit cards shall be maintained without reduction or abolition for at least one year after the new issuance of a credit card, and when changing additional services, reasons for change, details of change, etc. shall be applied.
