피고인은 2014. 4. 27. 21:50경부터 22:15경까지 서울 구로구 C에 있는 서울구로경찰서 D파출소 앞 노상에서 경찰관 모욕죄 등으로 벌금을 납부한 것에 대하여 불만을 품고 다수의 통행인들이 지켜보는 가운데 위 파출소 소속 경찰관인 피해자 E에게 "이 씨벌놈아, 네가 나를 예전에 넘겼지, 너 때문에 내가 벌금을 500만원이나 냈어, E 너, 내가 변호사 샀으니까 모가지를 잘라 버릴거야, 내가 20명 데리고 와서 다 죽여버릴거다, 야! 병신같은 새끼야, 경찰이 무슨 벼슬이냐, 씨벌놈들아"라고 큰소리로 말하여 공연히 피해자를 모욕하였다.
