Defendant shall be punished by a fine of five million won.

If the defendant fails to pay the above fine, 50,000 won shall be one day.

Punishment of the crime

When the defendant intends to import foreign goods, he/she is aware that the name, standard, quantity, price, etc. of goods are reported to the head of the customs office, and that a trademark identical or similar to the trademark registered with the Korean Intellectual Property Office is not used

5.2. In visiting China’s Mawre, the Defendant purchased 151 U.S. Gabre 151 points and 150,609,756 points at the Gabre product market, and requested Chinese nationals in the name of the Republic of Korea in the name of the Republic of Korea to transport Gab to 101 Dong 2703, Seoul, Jung-gu, Seoul, where Gabre B’s domicile. The said Chinese national requested the Defendant to transport Gabre Gabed goods with the trade name contained in the Gabre 1 Gab.

D, upon receiving the Defendant’s request for smuggling import from an unclaimed logistics company in the above trade name, collected smuggling imports from F, G, H, etc. with its own shape E, and then shipped 40 feet container 1, including one gambling house that the Defendant requested smuggling import, into transshipment cargo as if he were exported from China to Cambodia via Busan port. On June 8, 2012, the above container arrived at the port of Busan port, and then imported the total of 378 feet container 378 feet goods, including 1 feet, at the Defendant’s request, from J place of business located in Busan District on June 15, 2012.

As above, on June 15, 2012, the Defendant imported goods of KRW 151,68,852, and KRW 2,718,000 at the smuggling import price without filing an import declaration, and violated the Customs Act. On August 28, 1997, the Defendant used the trademark registration number “0373776” registered with the Korean Intellectual Property Office as the designated goods.
