1. The plaintiff's claim is dismissed.

Basic Facts

A. The pertinent Plaintiff is an enterprise that performs civil engineering and construction works, etc., and the Defendant is an order for the installation of the village sewerage in the Chungcheongnam-gu, Gwangju. On May 8, 2012, the Plaintiff entered into a construction contract with the Defendant to perform the construction works for sewage treatment plants and sewage pipes (hereinafter “instant construction contract”).

B. On May 8, 2012, the content of the instant construction contract and the Plaintiff and the Defendant concluded the instant construction contract with the total contract amount of KRW 1,102,034,000 and KRW 1/1000, respectively, on May 14, 2012, the date of commencement, May 13, 2013, the date of completion, and on May 13, 2013, the total contract amount of KRW 1,102,034,00, and the penalty for delay was modified several times thereafter.

In full view of the date of commencement stated in the first contract for the instant construction contract and the period of construction stipulated in other amended contracts, etc. on May 24, 2013, 201, based on the following factors: (i) the date of May 14, 2012 to August 25, 2013; (ii) the date of commencement specified in the original contract for the instant construction contract; and (iii) the date of construction stipulated in other amended contracts, etc., the reason for the change of the total contract amount (the original contract amount) as of June 21, 2012; and (iv) the period of construction stipulated in the other amended contract is deemed to be a clerical error as of May 14,

The settlement of insurance premiums of 000 premiums from May 14, 2013 to September 14, 2013, 2014:

C. The Plaintiff implementing the instant construction contract and the small and medium enterprise concluded construction on May 14, 2012 pursuant to the instant construction contract and completed January 21, 2014.

On June 7, 2012, the Defendant paid 440,000,000 won as advance payment to the Plaintiff and the Small and Medium Enterprise, and paid 1,126,584,000 won in total by the beginning of 2014 as follows. Of this, the amount paid to the Plaintiff, except for the amount paid to the Small and Medium Enterprise, is KRW 1,082,90,000 in total.

On June 7, 2012, the amount of advance payment: 440,000,000 on September 27, 2012: progress payment 252,640,000 on November 28, 2012; 202,700,000 progress payment on November 28, 2012; the progress payment on June 28, 2013; 68,308,000 progress payment on June 28, 2013;
