A defendant shall be punished by imprisonment for not more than ten months.

However, the execution of the above punishment shall be suspended for two years from the date this judgment becomes final and conclusive.

Punishment of the crime

1. No person who violates the Copyright Act shall infringe upon any author's property right or other property rights protected under the Copyright Act by means of reproduction, performance, public transmission, distribution, lease, or preparation of a derivative work;

Nevertheless, on November 1, 2015, from around August 3, 2016 to around August 3, 2016, the Defendant established two computers at his own dwelling in Daegu-gun-gun, and opened “Nei 1,” an Internet game owned by UN CFT, which is an Internet game in which the Defendant used the copyright, the Defendant established “Ne 1,” and promoted programs to enable game users to access the said private server, thereby enabling them to play the said private server. The Defendant arbitrarily created the game machine in the total amount of KRW 6,980,000.

Accordingly, the Defendant infringed on the author's property right of the UNCF Co., Ltd. by reproducing and distributing n't for profit.

2. No person who violates the Act on the Promotion of the Game Industry shall engage in a business of exchanging or arranging exchange or re-purchase of tangible and intangible results obtained through the use of game water;

The victim purchased, at a low price, the game money used by the private server users of the one game in which they play the game and resell it at a high price. From January 8, 2012 to August 3, 2016, he/she acquired profits of KRW 32,04,693,00, in total, 8,423 times of the game money created voluntarily by the operators, such as E, F, G, H, I, J, J, and K, a private server of the one game in the same place, from January 8, 2012 to August 3, 2016.
