1. The defendant shall pay to the plaintiff KRW 77,813,368 and KRW 76,307,106 among them, a year from March 29, 2019 to the day of full payment.

On December 27, 2016, the Plaintiff leased KRW 140 million to the Defendant at the interest rate of 6.9% per annum, overdue interest rate of 9.9% per annum, and the loan period of 60 months; the Defendant lost the benefit under September 28, 2018 upon delinquency in paying the principal and interest; the Plaintiff’s failure to receive overdue interest of KRW 1,286,262 and KRW 220,00,000 from the Defendant until March 28, 2019; or the fact that the Plaintiff was unable to receive overdue interest of KRW 76,307,106, and KRW 1,286,262 from the Defendant, and KRW 220,000 from dump auction expenses until March 28, 2019, may be recognized by comprehensively taking into account the overall purport of pleadings as stated in the evidence No. 1 through 11

Therefore, the Defendant is obligated to pay to the Plaintiff damages for delay calculated by applying the agreed interest rate of 9.9% per annum from March 29, 2019 to the date of full payment of the principal and interest of the loan amount of KRW 77,813,368 and the principal of the loan amount of KRW 76,307,106.

Therefore, the plaintiff's claim of this case is reasonable, and it is decided as per Disposition by the assent of all participating Justices.
