A defendant shall be punished by imprisonment for six months.

However, the execution of the above punishment shall be suspended for two years from the date this judgment becomes final and conclusive.

Reasons

Punishment of the crime

The Defendant is the owner and lessor of the studio in Gwanak-gu in Seoul Special Metropolitan City, and the victim D (Inn, 21 years old) entered into a lease agreement on December 26, 2012 with the Defendant on 302 of the above studio in Seoul Special Metropolitan City.

1. Intrusion upon residence;

A. On December 27, 2012, the Defendant: (a) around 03:00 on December 27, 2012, the studio 302 in which the said victim is residing; (b) it was confirmed that the said studio 302 was flick; (c) the Defendant opened a locked studio using Turkey, which was possessed in advance against the intent of the victim, and infringed upon the victim’s residence.

B. On March 19, 2013, around 19:00 on the date, the Defendant infringed upon the victim’s residence in the same manner as the above paragraph (a) on the premise that the number of cable broadcasting equipment was confirmed.

C. On July 13, 2013, around 13:00, the Defendant infringed upon the victim’s residence in the same manner as the above paragraph (a) against the victim’s will who openly saw in the above studio.

On August 15, 2013, the Defendant: (a) around 15:00, and around 302, installed cable TV machines; (b) infringed upon the victim’s residence in the same manner as the above paragraph (a) against the victim’s will.

E. On September 12, 2013, around 12:00 on the date, the Defendant came to check the studio 302, and infringed upon the victim’s residence by the same method as the above paragraph (a) against the victim’s will.

2. On October 14, 2013, the Defendant committed indecent act by compulsion: (a) in mind, at around 22:30, 2013, the Defendant committed indecent act by compulsion of a report by compulsion of a victim, who took meals with only clothes attached to the instant room; and (b) even if no CCTV was installed in the said room, the Defendant considered the victim as a CCTV to have a male boarding of the said room every day.
