The first instance court.

1. Basic facts

A. 1) On April 14, 2010, the Plaintiff entered into an insurance contract with the Defendant as the insured on April 14, 2010 (hereinafter “instant insurance contract”).

A) Around February 27, 2014, the Defendant filed an application with the Plaintiff to change the contractor of the instant insurance contract to B from himself/herself, and the contractor of the instant insurance contract was changed to B on February 27, 2014. (2) The Defendant and the Appointed B are in de facto marital relationship.

B. Based on the occurrence of an insurance accident and the payment of insurance proceeds, the Defendant received from the Plaintiff, from December 6, 2010 to December 22, 2010, the hospitalized treatment was conducted at C’s Council members from March 28, 2014 as indicated in Table 1, from that time until March 28, 2014, and received from the Plaintiff totaling KRW 18,690,000 as insurance proceeds under the instant insurance contract.
