All of the prosecutions of this case are dismissed.

Reasons

1. The summary of the facts charged is that the Defendant, as the representative of D in C in the period of harmony, is an employer who runs a manufacturing business using eight full-time workers.

The Defendant, from September 1, 2015 to January 9, 2017, 2017, worked in the above D and retired from office, did not pay the total of KRW 16,127,020 and retirement allowances of KRW 5,189,469 within 14 days from the date of retirement, as stated in the list of crimes in attached Table 1, including the fact that the parties did not agree on the extension of payment date, and did not pay the total of KRW 37,391,806 for two workers within 14 days from the date of retirement, as stated in the list of crimes in attached Table 1.

An employer of the 2017 Highest 4063 [Attachment 4063] paid wages, compensations, and all other money and valuables to a worker who died or retires, within 14 days after the cause for such payment occurred, the Defendant, from August 1, 2015 to the above D, did not pay the total of 10,894,060 won of the F’s wages and retirement allowances and 5,733,312 won of the retirement worker who retired from office around March 6, 2017, within 14 days after the date of retirement without agreement on the extension of the payment period.

An employer of the 2017 Highest 4405 shall pay wages, compensations, and all other money or valuables to a worker within 14 days after the cause for such payment occurred if the worker dies or retires, and shall pay the worker a retirement allowance within 14 days after the cause for such payment occurred if the worker retires.

Provided, That the date may be extended by mutual agreement between the parties in extenuating circumstances.

Nevertheless, the Defendant: (a) the sum of wages of G workers who worked from the above D to March 2, 2017, including KRW 3,916,580 on November 1, 2016; (b) wage of KRW 4,547,200 on December 2, 2016; (c) wage of KRW 4,547,200 on January 1, 2017; (d) wage of KRW 4,547,200 on February 4, 2017; and wage of KRW 293,367 on March 2, 2017; and (e) wage of KRW 17,851,547; and retirement allowance of KRW 6,814,570 on March 2, 2017; and (e) wage of KRW 4 workers, such as wage of KRW 6,814,570 on March 2, 2012.
