1. The Defendant shall pay to the Plaintiff KRW 88,454,708, as well as 5% per annum from December 1, 2010 to October 19, 2016.
Reasons
1. Indication of claims: as shown in Appendix 1.
2. Applicable provisions of Acts: Judgment without pleadings (Articles 208 (3) 1 and 257 of the Civil Procedure Act);
3. Partial dismissal: Pursuant to the provisions on statutory interest rate under Article 3(1) main sentence of Article 3(1) of the Act on Special Cases concerning Expedition, etc. of Legal Proceedings (Presidential Decree No. 26553, Sept. 25, 2015) that was amended as of September 25, 2015 and enforced as of October 1, 2015, the portion in excess shall be cited by applying 15% per annum from the day following the delivery of a copy of a complaint to the delay damages rate under the Act on Special Cases concerning Expedition, etc. of Legal Proceedings.
