1. Of the judgment of the court of first instance, the part against the defendant exceeding the amount ordered to be paid below shall be revoked.
Reasons
1. The following facts are either in dispute between the parties, or in full view of the purport of the entire pleadings, each of the descriptions of evidence Nos. 1, 2, 3-1, 2, 4-6, 7-1 through 11, 12, 13, 1, 1, 2, 4, 12, and 12, and 12.
The plaintiff is a company engaged in indoor construction business, etc., and the defendant is a company engaged in construction business, etc.
B. On March 26, 2015, the Defendant entered into a contract for construction works with H, setting the construction cost of KRW 1.75 billion and the construction cost of KRW 1.75 billion as of September 15, 2015 as the date of completion as the construction cost.
C. After November 5, 2015, Defendant and I entered into a contract to modify the content that the construction cost of the instant newly-built construction contract was KRW 1.59 billion, and that the date of completion was changed to November 30, 2015, respectively, and that I issued a promissory note to the Defendant to secure KRW 170 million of the completion reserve amount and the remainder amount, which is KRW 200 million of the completion reserve amount and KRW 170 million of the completion reserve amount.
From October 21, 2015 to January 9, 2016, the Plaintiff invested human resources to the new construction site of the instant case, and performed the interior interior interior decoration among the new construction works of the instant case (hereinafter “instant construction”).
E. After completing the instant construction work on January 9, 2016, the Plaintiff filed a claim with the Defendant for the payment of KRW 110,202,200 (200,000 x 551.011) and KRW 76,363,637 (110,202,200 - 76,363,563 (200 - 76,363,637) and KRW 2450,00 (36,38,563,563,563,563 (38,56363,637) and KRW 2450,00,00,000,000 for the personal seal payment per day on January 10, 2016.
F. On January 25, 2016, E, the Defendant’s on-site director, served as the internal tree number of days a day from October 21, 2015 to January 9, 2016 at the new construction site of this case.
