1. The defendant shall pay 35,040,360 won to the plaintiff and 35,000,000 won among them to October 1, 2007 and January 9, 2008.

According to the purport of Gap evidence Nos. 1 and Eul evidence Nos. 1 through 4 and all of the pleadings, the plaintiff lent 35,00,000 won to the defendant on Oct. 14, 2004 on June 23, 2006, interest rate of 11.5%, and the defendant's failure to pay the above loan, and the plaintiff paid 35,000,000 won to the defendant on Oct. 14, 2004 to Oct. 14, 2004 to Jan. 9, 2008, "the defendant paid 30,000,000 won to the plaintiff and its interest rate of 10,000 won to 30,000 won per annum 20,000 won per annum 16,200,000 won per annum 9, 208.15.208, 2005.

Therefore, the defendant is obligated to pay to the plaintiff 35,040,360 won + 16,200 won + 200 won + 24,160 won) and damages for delay calculated by the rate of 11.5% per annum from October 1, 2007 to January 9, 2008 and 20% per annum from the next day to the day of full payment, as the plaintiff seeks from the day following the day of payment of the final damages for delay.

Thus, the plaintiff's claim of this case is accepted on the ground of the reasons.
