1. The Defendants: (a) KRW 58,129,354 to each of the Plaintiff, as well as KRW 5% per annum from April 27, 2011 to August 27, 2014; and (b).

Basic Facts

The Plaintiff, at the F Hospital in Jinju-si E (hereinafter “instant hospital”), is a person who received selective neutism (hereinafter “instant surgery”), and Defendant B and C are the operators of the instant hospital, and Defendant D are doctors who conduct the said surgery to the Plaintiff.

원고는 2002. 10.경 교통사고를 당한 이래로 경추의 염좌 및 긴장, 경추통, 상세불명의 척추증 등으로 치료를 받은 적이 있었고, 2008. 11.경부터는 이 사건 병원에 내원하기 전까지 신경뿌리병증을 동반한 경추간판장애, 기타 경추간판 변성, 상세불명의 경추간판 장애로 다른 병원에서 치료를 받은 적이 있었는데, 2011. 3. 9. 저녁 경 사천시에 있는 공원에서 윗몸일으키기 운동 중, 목에서 갑자기 ‘뚝’하는 소리가 나면서 통증이 발생되어 인근 병원에서 외래진료를 받다가 통증이 완화되지 아니하자, 2011. 4. 26. 이 사건 병원에 내원하였다.

On April 26, 2011, Defendant D performed the instant procedure with a view to relaxing the pass of the left-hand shoulder and the left-hand arms. After the instant procedure, the Plaintiff seems to have shown the pass of the part of the arms, and immediately after the instant procedure, the angle was lost from 30 minutes after the procedure to the sloping from the side of the bridge, and there was a maliology.

From April 26, 2011 to January 21, 2012, the day of the instant procedure, the Plaintiff received pharmacologic and physical therapy from the instant hospital. From July 8, 2011 to July 17, 201, the Plaintiff had received treatment at the Gyeong University Hospital. The Plaintiff was transferred to Samsung Seoul Hospital on July 23, 201, and was hospitalized. The Defendants agreed to pay the Plaintiff’s medical expenses at the Plaintiff’s Samsung Seoul Hospital to pay the Plaintiff’s share of the Plaintiff’s medical expenses, and prepared and submitted a written confirmation.

On July 28, 2011, and March 7, 2012, the Plaintiff was diagnosed by the Samsungnam Hospital as clinical presumption of the number of disease and injury, and walk now.
