1. Basic facts

A. On June 23, 2015, the Defendant concluded a contract on the entrustment of mobile phone devices, mobile communications services, etc. provided or sold by the Plaintiff’s Intervenor (hereinafter “Supplementary Intervenor”) with the Intervenor, and the Defendant concluded a contract on the entrustment of business (hereinafter “instant contract on entrustment of business”).

The following are the parts related to this case in the entrustment contract of this case.

Article 1 (Purpose) The purpose of this Agreement is to prescribe all matters related to the entrustment of the defendant to the sale of “products” and “products, etc.” provided or sold by the Intervenor to the supplementary intervenor in good faith.

Article 2 (Definitions of Terms)

1. The term "products" means mobile telephone terminals, USIM, devices related to the reception of DMB broadcasting, devices related to the transmission and reception of Internet services, wire and telephone, various additional services, IPTV reception-related devices, and other devices related to the reception of wired and wireless telecommunications, Internet broadcasting;

2. The term “products, etc.” means all kinds of services provided by “company, etc.”, such as mobile communication services, DMFB broadcasting services, wire and telephone services, wire and telephone services, and IPTV services, and goods or services related thereto;

3. The term “company, etc.” means a company designated by the SK Telecom Co., Ltd., SKB World Co., Ltd., TU media stock company, and other auxiliary intervenors.

Article 20 (Provision of Security, etc.)

1. In order to secure all obligations to an intervenor arising in connection with this contract, the Defendant shall provide the Intervenor with a guaranty insurance policy, real estate security, deposit pledge, bank payment guarantee, etc. as security equivalent to KRW 10,00,000 or equivalent amount determined by the Intervenor prior to the conclusion of this contract, as a security prior to the conclusion of this contract.

7. Where the Defendant has breached its obligations under this Agreement or caused damage to the Intervenor in violation of this Agreement, the Intervenor shall provide security under this Article.
