All appeals filed by the defendant and prosecutor are dismissed.

1. The gist of the grounds for appeal is that the Defendant filed each appeal on the grounds that the sentence imposed by the lower court (two years and six months of imprisonment) is too unreasonable and inappropriate. The prosecutor filed each appeal on the grounds that the lower court’s sentence is too uneasible and unreasonable.

2. The crime of this case was committed through the so-called Bophishing method by deceiving a number of victims' money. Such crime is a serious social and economic harm, such as impairing the security and reliability of financial transactions and causing serious inequality and danger to the society as a whole, and thus, requires strict punishment. In particular, considering that most victims are those who have difficulty in getting loans from financial institutions in a normal way, there is a high possibility of criticism. In addition, the crime of this case is planned, organized, and the defendant seems to have led each of the crimes of this case, the crime of this case is committed repeatedly over a long period of time, the victim committed the crime against many unspecified victims, the total amount of damage amounts to KRW 59,490,00, and the total amount of damage amounts to KRW 59,490,000, and the amount of damage has not been recovered most, and in particular, the crime of this case was committed during the period of repeated crime due to fraud.

On the other hand, the circumstances favorable to the defendant include the fact that the defendant recognized all of the crimes of this case as well as reflects the depth of each of the crimes, the fact that the case is not much serious in light of the amount of damage, and the fact that one of the victims has reached an agreement
