The defendant shall be innocent.
Reasons
1. On December 13, 2017, the Defendant, at around 22:00 on the charge of the instant charges, committed a dispute with each other on the grounds that the Defendant, while drunkly operating the said hotel at the seat of the Sinsan City B hotel, did not appear for the Defendant-friendly C and the Defendant-friendly C, who jointly operated the said hotel, did not appear to have been able to take over and take over the said hotel, and was able to put the said hotel on a Dunetna car that the Defendant gets on aboard.
At around 22:53 on the same day, the Defendant was registered in the name of E parked in the above hotel first floor parking lot, but in fact, the Defendant was placed in the above rocketing car, which is owned by the Defendant, on the top of the top floor, with the string of the string and the string of the string to attach fire to the inside of the said car.
Accordingly, the defendant destroyed his own automobile and caused public danger.
2. Determination
A. Fire-prevention to his own motor vehicle is a specific dangerous crime, which is established only when public danger arises as a result of the act, and such attempted crime is not punished. Therefore, the prosecutor must prove that the defendant's act of fire-prevention causes public danger.
B. In such a case, in light of the following facts and circumstances acknowledged in full view of the result duly adopted and investigated by the court, the evidence submitted by the prosecutor alone, which caused public danger to the defendant's fire-prevention act.
It is difficult to readily conclude and otherwise there is no evidence to acknowledge this.
1) As to the background of the instant crime at an investigative agency, the Defendant: (a) had a hotel parked in the hotel parking lot in order to have the hotel be faced with managerial difficulties and attempt to commit suicide; and (b) had a dog and a stop installed and strings of his own vehicle parked in the hotel parking lot in order to attempt suicide; and (c) tried to open a string door from the driver’s seat and turn off with his hand without waiting more than what he thought.
