The judgment of the court below is reversed.

Defendant shall be punished by a fine of KRW 5,000,000.

The above fine shall not be paid by the defendant.

1. Summary of grounds for appeal;

A. In light of the background leading up to the occurrence of the instant accident, the Defendant cannot be deemed to have been negligent in breach of his duty of care. Even if the Defendant’s negligence is recognized, causation between the Defendant’s negligence and the victim’s serious injury is not recognized.

Therefore, the judgment of the court below which convicted the charged facts of this case is erroneous in the misapprehension of legal principles.

B. The lower court’s sentence of unreasonable sentencing (under 8 months) is too unreasonable.

2.
