1. The defendant shall pay to the plaintiff KRW 166,486,512 as well as KRW 165,183,168 among them, per annum from May 13, 2014 to the day of complete payment.
Reasons
1. Indication of claim;
A. On August 29, 2013, the Plaintiff entered into a lease agreement with the Defendant, setting the acquisition cost of KRW 235,00,000 per annum, monthly rent of KRW 5,979,30 per annum, 36 months during the lease period, and delay damages rate of KRW 23.1 per annum.
B. As the Defendant did not pay rent, the Plaintiff terminated the above lease agreement on April 30, 2014.
C. The amount of arrears under the foregoing lease agreement as of May 12, 2014 is KRW 161,160,717 of the outstanding principal, KRW 4,022,451 of the outstanding amount, KRW 1,303,344 of the outstanding amount.
Therefore, the Defendant is obligated to pay damages for delay calculated by an agreement of 23.1% per annum from the day following the base date to the day of full payment with respect to the Plaintiff totaling KRW 166,486,512 (i.e., KRW 161,160,717 KRW 4,022,451 KRW 1,303,344) and the principal and statutory damages of the previous principal and statutory damages (i.e., KRW 165,183,168 (i.e., KRW 161,160,717 KRW 4,022,451).
