Defendant shall be punished by a fine of eight million won.
If the defendant fails to pay the above fine, 50,000 won shall be one day.
Reasons
Punishment of the crime
1. The defendant violating the Infant Care Act shall not be a person who establishes and operates a private child-care center, which is a private child-care center, from March 10, 199, and shall not receive a subsidy or appropriate a subsidy by fraud or other improper means;
A. On August 201, the Defendant, who received unjust childcare fees, etc., applied for a false basic childcare fees, allowances for employees, etc., as if he/she employed F and G as infant care teachers, to the Ministry of Sound and Military Administration, even though he/she did not employ F and G as infant care teachers, and received subsidies of KRW 2,137,90 in total seven times from August 201 to February 2012, 201, including that he/she received subsidies of KRW 15,511,160 in total from August 201 to February 2012.
B. A subsidy for overtime childcare activities for infant care teachers illegally receiving a subsidy for overtime hours may be granted only when he/she worked for at least six hours a day and up to 21:30 hours a day, but the Defendant was granted a subsidy of KRW 2,00,000 on March 15, 2012, even though he/she did not actually work for infant care teachers and did not meet the above conditions, the Defendant filed a false request for a subsidy with the Ministry of Sound and Military Affairs as if he/she actually worked for the said conditions, and received a subsidy of KRW 1,00,000 in total twice from April 2012, 200.
C. On January 24, 2010, the non-use of subsidies for dietitians is set at the above E Child Care Center on or around January 24, 201, and the fact is set at KRW 96,400,00 at will, notwithstanding that the 100,000 per month’s salary for dietitians of child care centers was paid at KRW 10,00,000, and the subsidy deposited in the above Child Care Center account (CF) was transferred to another account for operating expenses of the above E Child Care Center (CF) and then I paid KRW 100,000 to the other.
