Defendant
A shall be punished by imprisonment for four months, by imprisonment for six months, by a fine of one million won for each of the defendants C and D.
Reasons
Punishment of the crime
1. Defendant A, from March 2004 to September 201, 201, was the representative and the president of “I childcare center”, an individual private nursery facility in Yangcheon-gu Seoul, Yangcheon-gu, Seoul. A.
The founder or operator of infant care teachers and infant-care facilities shall not receive or use subsidies from the State, metropolitan organizations, or local governments by fraud or other improper means.
Nevertheless, the defendant's facts from June 7, 201 to the same year.
8. Until March 31, 200, even though the J had not served as the above child care teachers, it falsely registers J as the child care teachers to the Women's Welfare Department of Yangcheon-gu Office, and it received from the Yangcheon-gu Office a total of KRW 3,734,430 in the name of personnel expenses for infant care teachers, subsidies for school expenses, and teachers for the above-mentioned period from the office of Yangcheon-gu to the new bank account (K).
In addition, the Defendant received subsidies equivalent to KRW 25,781,430, total amount of KRW 25,781,430, from the above teachers to the above facility account by falsely registering as infant care teachers at the above childcare center from January 1, 2010 to August 31, 2011, or as D, L, M, and C whose working period has already expired, as infant care teachers, as shown in attached Table 1-1-5, as shown in attached Table 1-10, from September 1, 2009 to August 201, 201, and received subsidies equivalent to KRW 25,781,430, in total from the above teachers to the above facility account. As described in attached Table 1-6-10, as in attached Table 1-10, from September 1, 2009 to August 31, 2010, by falsely registering as if the Defendant had not been in the above childcare center, the basic infant care expenses, expenses between children, and children, expenses per half.
(b) A person who establishes and operates a child-care center illegally collected expenses for special activities shall use such child-care center;
