A defendant shall be punished by imprisonment for six months.

However, the execution of the above sentence shall be suspended for a period of two years from the date this judgment became final and conclusive.

Punishment of the crime

The Defendant, from April 2014, arranged the relationship with C on August 8, 2015 while living together with C, forged documents for application for joint and several sureties in the name of C to prepare for future living expenses, and used them to receive money.

1. Forgery of a private document, uttering of a falsified investigation document, and fraud on August 12, 2015;

A. On August 12, 2015, the Defendant forged private documents: around 11:00, at the “E” coffee shop located in Pyeongtaek-si D, the Defendant applied for a joint and several surety loan with the Defendant as the principal collector, and C as the joint and several surety jointly and severally surety each three million won; then printing out two copies of the “joint and several surety contract (for bond holders),” which he received in advance through the said lending company, through the said lending company, and then having a non-personal male sign on the “personal information” column of the guarantor of each of the above documents, “C, F, Nam-si G3: 405 million won,” and “10% of the loan amount,” “10% of the loan amount,” “20% of the loan amount,” “3:0% of the loan amount,” “20% of the loan amount,” and “3:0% of the loan amount,” and “3:0% of the loan amount,” “208.28% of the loan amount,”

Accordingly, for the purpose of exercising authority, the Defendant committed each of the two sections of the “joint and several surety contract” in the name of C, which is a private document on rights and duties.

B. At around 15:40 on the same day, the Defendant: (a) filed a forged private document by sending the forged document to the employees in charge of the lending brokerage company, as if he/she was a document duly formed with two copies of the joint and several surety agreement (for the purpose of bonds) that was forged as above, and held the forged private document by facsimile.

The criminal defendant is guilty on August 12, 2015.
