A was in charge of distribution and purchase sales at the astronomical premises of the victim E Co., Ltd. (hereinafter “victim E”) and Defendant B was engaged in the individual cargo transport business.

The Defendants offered a simplified receipt in blank state of Defendant B to Defendant A, and Defendant A claimed a consignment transport fee from the victim company based on the false transport content on the above simplified receipt, and conspired to receive the consignment fee from the victim company to the KB bank account (F) in the name of Defendant B.

On October 10, 2009, A made a false statement that Defendant B should pay the consignment charges to Defendant B while submitting a false simple receipt to the accounting department, which was prepared as if Defendant B received the cargo transport services equivalent to KRW 950,000 from the victim company, from the victim company, and received the cargo transport services equivalent to KRW 950,000 from the victim company.

However, there was no fact that Defendant B had transported cargo by arranging the carriage of cargo from the victim company.

Nevertheless, the Defendants, by deceiving employees in charge of the victim company as above, received KRW 950,00 from the victim company's above KB bank account from the victim company to KRW 150,00,00 from February 11, 2012, as well as 1,2,4,5,6,12,13,15,16, 20, 21, 22, 24, 30, 32, 36, 39, 40, 46 (limited to KRW 30,00,00), 16, 20, 18, 16, 30, 16, 16, 20, 18, 16, 16, 20, 16, 16, 30, 47, 56 (limited to the amount acquired through deception as KRW 33,34,00,000, 67, 97, 97, 796, 70.
